Dumpster Rental Agreement
Effective September 1, 2026 · Version 2026-09-01-booking-review-v6
Please read this entire agreement before signing and paying. The price, cancellation deadline, saved-card authorization, material restrictions, customer responsibilities, and possible added costs are part of the rental—not hidden website fine print.
1. Agreement, Customer Authority, and Electronic Signature
This Dumpster Rental Agreement is between Marucci Enterprises LLC, doing business as Marucci Enterprises (Marucci Enterprises), and the person or business placing the booking (the customer). It applies to the booking, delivery, use, pickup, disposal, payment, and any approved extension, dump-and-return, reschedule, or added service connected with that booking.
The customer confirms that they are at least 18 years old, have authority to order the service, have authority to place the trailer at the requested location, and have the legal right to dispose of every item placed in it. Typing the customer's full legal name and selecting the agreement box is intended as the customer's electronic signature. The signed version stored with the booking controls that booking even if these public terms are changed later.
2. Standard Rental Price and What It Includes
A standard construction-and-demolition rental is $300 for the first day. It includes delivery, the first rental day, pickup, and disposal of the first standard trailer load. Each additional rental day is $75. Each additional dump-and-return is $175. There is no deposit and no included additional dump.
Online checkout is available only when the routing provider calculates the delivery address at no more than 50 one-way driving miles from Marucci Enterprises' private Biloxi dispatch point. An address beyond 50 routed miles may still be serviced by custom arrangement, but it cannot be booked through the standard online checkout; call or text (228) 273-5522 to discuss availability and pricing.
For an address eligible for online checkout, a $100 travel fee applies when the routing provider's standard estimated one-way drive time is 45 minutes or longer. The standard estimate does not use temporary live-traffic delays. Marucci Enterprises shows the resulting eligibility and any fee before the customer signs and pays, then recalculates them before checkout. If that fee changes, checkout stops so the customer can review the revised total, repeat the electronic signature, and give both approvals again. If the address is partial, cannot be validated to a specific street or premises, or cannot be routed, online checkout is unavailable until the customer corrects it or contacts Marucci Enterprises.
The address check uses Google Maps Platform. The service address is sent securely from the website server to Google for this calculation. Marucci Enterprises does not retain Google's raw route distance or duration; the booking record retains the business result, any charged travel fee, the policy version, and the check time. Use of Google Maps content is subject to the Google Maps Platform Terms of Service at https://cloud.google.com/maps-platform/terms and Google's Privacy Policy at https://policies.google.com/privacy.
Heavy, restricted, separated, contaminated, or specially handled material may cost more. The upfront checkout total covers the selected standard rental days and any travel fee displayed there. Other charges apply only as disclosed in this agreement.
3. Full Payment and Saved-Card Authorization
The full total shown at checkout, including any displayed travel fee, is charged when the booking is placed and reserves one of the two live rental slots. There is no standard rental balance due at delivery. The payment processor handles card information; Marucci Enterprises stores payment tokens and transaction identifiers, not the card number.
I authorize Marucci Enterprises to save the payment method used for this booking and to initiate zero or more variable, event-triggered off-session charges arising from this specific dumpster rental. These are not scheduled recurring payments. A charge may be made during the rental or after pickup when the amount becomes known, and only for fees or documented costs described in the Dumpster Rental Terms, including $75 additional rental days, $175 dump-and-return trips, approved additional travel caused by a customer-requested address change after booking, the $125 overloading charge, prohibited or undisclosed materials, failed access or waiting time, cleanup, damage, unauthorized relocation or recovery, disposal charges, permits, fines, and other customer-caused costs. The ordinary travel fee calculated from the address entered during booking is shown and paid as part of the upfront checkout total, not added later under this authorization. Each later amount will be the published fixed fee or the documented actual cost described in these terms. Marucci Enterprises will provide an itemized receipt after each successful charge. This authorization applies only to this rental and ends when all charges associated with it have been resolved. Revoking authorization does not erase charges already incurred.
A later charge is made only after the owner reviews the booking and the supporting reason. Fixed charges use the published amount. Variable charges use documented actual third-party costs or reasonable labor, equipment, repair, recovery, or disposal costs caused by the customer or site condition. If an off-session card charge is declined or requires customer authentication, the amount remains due and Marucci Enterprises may send an invoice or secure payment link.
4. Customer Cancellation and Rescheduling
A customer cancellation received at least 48 hours before the scheduled delivery window receives a full refund to the original payment method. When no narrower arrival time has been confirmed in writing, the delivery window begins at 7:00 a.m. Central Time on the selected delivery date, so the cancellation deadline is 7:00 a.m. Central Time two calendar days before delivery.
A customer cancellation received less than 48 hours before the delivery window, after the truck has been dispatched, or after delivery is nonrefundable because the trailer and driver capacity were reserved and the short notice may prevent replacement work, except where applicable law gives the customer a greater cancellation right. The customer must send the cancellation or reschedule request by call, text, or email so the time can be documented.
If Marucci Enterprises approves one reschedule before dispatch and before 7:00 a.m. Central Time on the original selected delivery date, the existing payment transfers to an available replacement date and the customer does not pay the same rental total twice. The included reschedule closes at that original delivery-window start even if the booking still shows as confirmed or the truck has not yet been dispatched. Price changes caused by added days, material, or a different location remain due. A customer-requested address change is routed again: it may change the travel fee, and an address beyond the 50-mile standard online area requires a separate written custom arrangement. Rescheduling does not restart an expired refund deadline: if the original booking was already inside the nonrefundable period, moving the date does not make the payment refundable unless Marucci Enterprises agrees in writing.
If Marucci Enterprises cannot provide the booked rental, the customer may transfer the full payment to an available date or receive a full refund. A payment-processor refund can take additional time to appear at the customer's bank.
5. Delivery, Pickup, Availability, and Operating Conditions
The selected dates reserve trailer capacity, not an exact arrival minute. Delivery, dump-and-return, and pickup times are estimates and may change because of route order, traffic, weather, road conditions, site access, landfill or transfer-station hours, disposal rejection, equipment conditions, safety, emergencies, or other events outside reasonable control. Marucci Enterprises will communicate material changes when practical but is not responsible for indirect losses caused by an arrival-time change.
Weekend delivery or pickup may be available. Weekend dumping is not guaranteed because disposal facilities may be closed or operating on limited hours. Storm-response mobilization and additional hauling capacity are scheduled separately from the two ordinary online rental slots.
6. Address, Access, Placement, Permits, and Property Conditions
The customer must provide an accurate, complete service address and a clear placement description. The online route and travel fee are based on that address. The customer must promptly disclose any correction or requested address change before dispatch; the new address is subject to route eligibility, price adjustment, access review, and written approval. Access notes and photos are optional booking aids, but the customer must accurately disclose any known gate, narrow turn, slope, soft ground, overhead wire or limb, parked vehicle, paving limit, septic system, irrigation, buried utility, drainage, landscaping, property rule, or other condition that could affect safe delivery or pickup. Leaving the optional fields blank does not shift responsibility for an undisclosed condition to Marucci Enterprises.
The customer selects and authorizes the placement area and is responsible for obtaining owner, landlord, association, municipal, right-of-way, or permit approval. Marucci Enterprises may refuse or change a requested placement that appears unsafe or inaccessible. The customer assumes the risk of surface, lawn, landscaping, pavement, utility, septic, irrigation, or structure damage resulting from a customer-selected location, undisclosed condition, inadequate load-bearing surface, or required truck/trailer access, except to the extent caused by Marucci Enterprises' negligence.
The access path and trailer must remain unobstructed for scheduled service. If delivery or pickup cannot be completed because of blocked access, inaccurate directions, locked gates, vehicles, unsafe conditions, or missing permission, additional rental days continue and the customer is responsible for documented return-trip, driver, equipment, waiting, recovery, permit, towing, or other direct costs caused by the failed access.
7. Material Disclosure and Restricted or Prohibited Items
Before signing, the customer must affirmatively select either “None of these items” or every listed restricted-material category that may be present. The ordinary material-type field is optional, but this restricted-material disclosure is required. The customer must update Marucci Enterprises before loading if the material changes or the disclosure becomes inaccurate. Restricted items are not accepted unless Marucci Enterprises expressly approves them in writing and gives handling instructions. Disclosure does not guarantee acceptance; some materials cannot lawfully or safely be transported or accepted at the available facility.
- Paint, stain, solvents, oil, fuel, chemicals, pesticides, liquids, or hazardous-material containers
- Tires or batteries
- Electronics or fluorescent bulbs
- Refrigerators, freezers, HVAC equipment, or other refrigerant-containing items
- Propane tanks, pressurized cylinders, fireworks, ammunition, or explosives
- Food, spoiled material, medical or biohazardous waste, asbestos, radioactive material, hot ashes, burning material, or other illegal or regulated waste
- Concrete, dirt, brick, roofing, or other unusually heavy or concentrated construction material
- Other regulated, prohibited, or restricted material
8. Loading, Overloading, and Safe Use
Material must remain at or below the marked fill line, be distributed evenly, remain contained, allow the door to close, and keep the trailer within a safe legal load. An overfilled, uneven, unsecured, or unsafe load carries a $125 overloading charge. That charge does not buy permission to haul an unsafe load: the customer must still remove or rearrange material before transport and remains responsible for resulting labor, equipment, delay, return-trip, and disposal costs.
The customer must not move, tow, lift, alter, paint, burn in, mechanically compact material in, or attach equipment to the trailer. The customer must not climb on the trailer or permit children, unauthorized people, or animals to enter or play on or around it. The trailer remains Marucci Enterprises property and may be removed if it is being misused or creates a safety or legal risk.
9. Customer-Caused Fees and Documented Costs
In addition to the published fixed charges, the customer is responsible for reasonable, documented costs caused by the customer's acts, omissions, materials, guests, contractors, site, or requested placement. Listing a category does not create an automatic fee; the charge must relate to an incurred cost or work made necessary by the booking.
- Disposal-facility rejection, special handling, sorting, separation, environmental response, cleanup, manual unloading, or return of prohibited, undisclosed, mixed, contaminated, or improperly loaded material
- Extra driver time, waiting, return trips, failed delivery or pickup, additional rental days, towing, recovery, relocation, or equipment required because access or the load was not ready
- Repair, professional cleaning, replacement, recovery, and reasonable loss-of-use caused by customer damage, theft, vandalism, fire, unauthorized movement, or misuse of the trailer
- Tickets, fines, impound, permit charges, property-owner charges, taxes, landfill surcharges, or third-party claims caused by the customer's placement, material, instructions, or failure to obtain permission
- Reasonable collection costs and attorney fees to the extent permitted by law for an unpaid, valid charge
10. Inspection, Refusal, Correction, and Evidence
Marucci Enterprises may inspect, photograph, refuse, delay, or stop service for a load, route, placement, or site that appears unsafe, illegal, overweight, prohibited, inaccessible, or inconsistent with the customer's disclosure. The customer must remove, separate, rearrange, or correct unacceptable material or conditions before transport.
If the customer does not make the load safe, Marucci Enterprises may leave the trailer in place, continue daily rental charges, remove the trailer when legally and safely possible, or perform reasonable correction work at the customer's cost. Marucci Enterprises may retain booking, communication, condition-photo, delivery, pickup, facility, weight, receipt, payment, and event records to operate the rental, document performance, resolve disputes, and collect valid charges.
11. Customer Responsibility, Indemnity, and Liability Limits
The customer is responsible for the trailer and its use while it is at the service location and for acts of the customer's household members, employees, contractors, guests, tenants, and invitees. To the extent permitted by law, the customer agrees to defend, indemnify, and hold Marucci Enterprises harmless from third-party claims, fines, losses, cleanup obligations, damages, and reasonable legal costs arising from the customer's materials, negligence, misuse, unauthorized placement, lack of permission, unsafe load, or breach of this agreement, except to the extent caused by Marucci Enterprises' negligence or willful misconduct.
To the extent permitted by law, Marucci Enterprises is not liable for indirect, special, incidental, punitive, lost-profit, lost-use, project-delay, or consequential damages. Except for liability that cannot legally be limited and claims caused by gross negligence or willful misconduct, Marucci Enterprises' total liability arising from a rental will not exceed the amount the customer paid for that rental.
12. General Terms and Contact
Mississippi law governs this agreement, without regard to conflict-of-law rules. Any lawsuit must be brought in a court with jurisdiction in the Mississippi county where Marucci Enterprises has its principal office, unless applicable law requires another location. If a provision is invalid or unenforceable, the remaining provisions continue. A delay in enforcing a provision is not a waiver. This agreement and any written booking-specific change are the entire rental agreement; a material change must be documented in writing.
